The council convened in open session on Wednesday, November 04, 2015, at 6:30 p.m. in the council chambers.  Notice was given in advance by publishing in the Randolph Times.  Council acknowledged by Receipt of Notice.  Present were Mayor Schutt, Councilmen Lemmons, Bargstadt, Winkelbauer, City Attorney Carlson, City Administrator/Clerk/Treasurer, Police Chief Greiner, Economic Development Director VanMeter and news reporter Deanna Anderson.  Absent, Councilman Wattier.  Mayor Schutt advised those present of the location of the posted information regarding the Open Meetings Act.

Motion by Lemmons, seconded by Bargstadt to approve the minutes of October 7 and 15, 2015.  ROLL CALL YEAS: Winkelbauer, Lemmons, Bargstadt NAYS: None ABSENT: Wattier

Larry Arens and Ken Curry addressed the council regarding proposed Nebraska Public Power Contract renewal, effective January 01, 2016.  Following discussion, motion by Bargstadt, seconded by Lemmons to renew contract A for a period of 20 years.  ROLL CALL YEAS: Winkelbauer, Bargstadt, Lemmons NAYS: None ABSENT: Wattier

Councilman Lemmons introduced Ordinance No 673 entitled:

AN ORDINANCE OF THE CITY OF RANDOLPH, NEBRASKA TO EXTEND THE TERM OF CABLE ONE, INC.’S FRANCHISE FOR A PERIOD OF FIVE (5) YEARS BEYOND ITS CURRENT EXPIRATION DATE; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.

And moved the statutory rule requiring reading on three separate occasions be suspended.  Seconded by Bargstadt.  ROLL CALL YEAS: Winkelbauer, Bargstadt, Lemmons NAYS: None  ABSENT: Wattier

Councilman Lemmons than read Ordinance No. 673 by title and moved for adoption of same.  Seconded by Winkelbauer  ROLL CALL YEAS: Bargstadt, Lemmons, Winkelbauer NAYS: None ABSENT: Wattier

Interlocal Cooperation Agreement with the Lower Elkhorn Natural Resources District presented by Jones for renewal with the City.  Motion by Bargstadt, seconded by Winkelbauer to approve renewal of same.  ROLL CALL YEAS: Lemmons, Bargstadt, Winkelbauer NAYS: None  ABSENT: Wattier

Mayor Schutt made the following appointments to the park board:  Scott Backhaus, Tim Kint, Aaron Nielsen, Jim Schnoor, Megan Schearer, Tina Thelen, Andy Thelen.  Motion by Lemmons, seconded by Bargstadt to approve the appointments.  ROLL CALL YEAS: Winkelbauer, Lemmons, Bargstadt NAYS: None ABSENT: Wattier

Mayor Schutt presented resignation received from Carolyn Lackas as EMT for the Randolph Rescue Squad.  Motion by Lemmons, seconded by Bargstadt to accept resignation.  ROLL CALL YEAS: Winkelbauer, Bargstadt, Lemmons NAYS: None ABSENT: Wattier  Mayor and council wish to express their appreciation for her dedicated service to the community.

Motion by Bargstadt, seconded by Winkelbauer to approve Christmas Lighting Discount for all customers signing up for same, the discount will be for the first 100 KWh of the December bill, due January 1st.  ROLL CALL YEAS: Lemmons, Bargstadt, Winkelbauer NAYS: None  ABSENT: Wattier

Department Reports:  Randy reviewed specs for a new boom truck for the electric department.  Motion by Lemmons, seconded by Winkelbauer authorizing clerk to advertise for bids for same.  ROLL CALL YEAS: Bargstadt, Winkelbauer, Lemmons NAYS: None ABSENT: Wattier.  Police Chief Greiner presented department report.  Also provided information on new police car.  Gary VanMeter provided copy of his report to the council.  Aaron discussed purchase of new snow bucket for tractor for the street department.  Consensus of council to approve same.

Motion by Lemmons, seconded by Bargstadt to enter into executive session at 8:42 p.m. to discuss personnel.  ROLL CALL YEAS: Winkelbauer, Lemmons, Bargstadt NAYS: None ABSENT: Wattier.  Motion by Bargstadt, seconded by Winkelbauer to adjourn executive session at 8:55 p.m.  ROLL CALL YEAS: Lemmons, Bargstadt, Winkelbauer NAYS: None ABSENT:  Wattier  Council to hold special meeting Tuesday, November 10, 2016 at 6:00 p.m. to discuss golf course well and to review employment applications received for position of city clerk/treasurer.  With no further business to come before the board, motion by Lemmons, seconded by Winkelbauer to adjourn.  ROLL CALL YEAS:  Bargstadt, Lemmons, Winkelbauer NAYS: None ABSENT: Wattier

ORDINANCE NO. 673

AN ORDINANCE OF THE CITY OF RANDOLPH, NEBRASKA TO EXTEND THE TERM OF CABLE ONE, INC.’S FRANCHISE FOR A PERIOD OF FIVE (5) YEARS BEYOND ITS CURRENT EXPIRATION DATE; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF RANDOLPH, NEBRASKA:

Section 1.  The City of Randolph has reviewed and evaluated the performance of Cable One, Inc. for the preceding five-year period and finds that:

• Cable One, Inc. has substantially complied with the material terms of the existing franchise and with applicable law; and

• The quality of Core Cable Service and Auxiliary Cable Service as defined in Section 1 of Ordinance No. 611, including, but not limited to, signal quality, response to consumer complaints, and billing practices, has been reasonable in light of community needs; and

• Cable One, Inc. continues to have the financial, legal and technical ability to provide the services, facilities and equipment to operate its cable system as proposed to the City; and

• Cable one Inc.’s plans for future operations are reasonable to meet the future cable-related community needs and interests, taking into account the cost of meeting such needs and interests.

Section 2.  Pursuant to Section 21D of Ordinance No. 611, a copy of which Ordinance is attached hereto as Exhibit “A”, the City of Randolph hereby extends the term of Cable One Inc.’s franchise for a period of five (5) years beyond its current expiration date so that the franchise shall now expire on July 1, 2031.

Section 3.  That the effective date of this Ordinance shall be from and after its passage, approval and publication in pamphlet form as required by law.

ADVERTISEMENT FOR BIDS

The City of Randolph, Nebraska, will receive bids for a 2015 or newer 55 foot aerial truck.  Bids will be accepted until 6:30 p.m. December 2, 2015, at the office of the City Clerk, 212 E. Broadway, P O Box 457, Randolph, Nebraska, 68771.  At that time, all bids will be opened and publicly read aloud.

Specifications are on file at the office of the City Clerk in Randolph, Nebraska.  A copy of the specifications for personal use may be obtained from the City Clerk’s Office, P O Box 457, Randolph, Nebraska 68771, (402) 337-0567.

No bids shall be withdrawn after the opening of bids without the consent of the City of Randolph, Nebraska, for a period of 30 days after the scheduled time of closing of bids.

The owner reserves the right to reject any and all bids and to waive any technicalities in bidding.
