PUBLIC HEARING NOTICE
Notice is hereby given that a public hearing will be held by Cedar County Transit System at the Cedar County Courthouse at 11 a.m. November 22, 2011 for the purpose of considering a project for which financial assistance is being sought from the Federal Transit Administration, pursuant to the Federal Transit ACT (FTA), generally described as follows:
Cedar County Transit System is seeking the purchase of a new lowered floor minivan to be operated in Cedar County for the general public transportation needs. Cedar County has taken into consideration the special needs of the elderly and/or persons with disabilities and therefore the minivan will be equipped to accommodate a wheelchair passenger.
At the hearing, Cedar County will afford an opportunity for interested persons or agencies to be heard with respect to the social, economic and environmental aspects of the Project. Interested persons may submit orally or in writing evidence and recommendations with respect to said Project.
A copy of the Application for a Federal Grant for the proposed Project is available for public inspection at the Cedar County Clerk’s office.

HARTINGTON CITY COUNCIL
Minutes
October 10, 2011
On October 10, 2011 the Hartington City Council met for their regular meeting at the city hall beginning at 7:00 P.M. Notice of time and place of the meeting was given in the advance notice by posting. Notice of time and place of the meeting was communicated in the advance notice to the mayor and council.
Present were Councilpersons Burbach, Christensen, Kruse, and Addison; Legal Adviser Pier; and City Clerk ~ Treasurer Lenzen. Absent was Mayor Peitz. Councilman Burbach, President of the Council, called the meeting to order followed by all present reciting the Pledge of Allegiance. He announced that the open meeting law poster was on the back wall of the council room and asked all present to silence their cell phones.
A motion to approve the minutes of the September 26, 2011 meeting and the September 2011 treasurers report was made by Kruse and seconded by Addison. A roll call vote was taken. Kruse – yes, Addison – yes, and Christensen – yes. Motion carried.
A sign permit submitted by the Chief Bar was reviewed. A motion to approve the permit was made by Addison and seconded by Christensen. A roll call vote was taken. Addison – yes, Christensen –yes, and Kruse – yes. Motion carried.
Dan Smith, D. A. Davidson & Co. and Dan Kathol presented the bonding procedure that needs to be taken to finance the W. Darlene Street paving project. An estimate for the bond amount is $37,000. The property owners on the north side of W, Darlene Street west of Cornel Street will be assessed for their portion of the project. December 19, 2011 is the date set for a public hearing. All bans will be offered the opportunity to purchase the bonds.
A motion was made by Kruse and seconded by Christensen to table agenda item No. 6 – LB840 funding – Westfield Acres. A roll call vote was taken. Kruse – yes, Christensen – yes, and Addison – yes. Motion carried.
The next item on the agenda was Tim Burbach – water line, utility easement and driveway entrance. Mr. Burbach began by reading a letter describing his and his wife’s intention for developing their property north of the shelter house. He also apologized for any action he had taken that had offended anyone while serving as a councilman. Mr. Burbach went on to explain that the city would have an easement to the water line and to cross his property for future sewer line development. A fire hydrant will be installed on the north end of the water line. Councilperson Addison asked Legal Adviser Pier if there were any state statues or city ordinances prohibiting a driveway entrance onto a park road. Mr. Pier said he had research this question and had found nothing to not allow the access.
A lengthy discussion followed. Several citizens were present and expressed concerns. A main concern was the driveway entrance onto the park road. Several suggestions were given of where the driveway should be located. Another suggestion was that property be purchased to the east and have the entrance onto Highway 57. The question also arose if more than one house was built. If that was the case a sub division would have to be created and all the necessary steps taken for it to become a part of the city.
Councilman Christensen commented that the citizens concerns had not fallen on deaf ears. Councilman Christensen than made the motion to approve the request of Mr. Burbach granting the water line, utility easement and driveway entrance as presented in the plans. The motion was seconded by Kruse. A roll call vote was taken. Christensen – yes, Kruse – yes, and Addison – yes. Motion carried.

GENERAL: Councilman Burbach suggested the council begin procedures to provide information to property owners who would be affected by future paving projects. Eisenbraun & Asso. have completed a study documenting design and cost.
