CITY OF HARTINGTON

Minutes

October 12, 2015

The City of Hartington had scheduled a meeting for Monday, October 12, 2015 but it was postponed to Wednesday, October 14, 2015 because lack of a quorum. The rescheduled meeting was at the city hall beginning at 7:00 P.M. Notice of time and place of the meeting was given in the advance notice by posting. Notice of time and place of the meeting was communicated in the advance notice to the mayor and council.

Present were Mayor Peitz; Councilpersons Kruse, Christensen, and Bartling; and City Clerk ~ treasurer Lenzen. Absent were Councilwoman Addison and Legal Adviser Pier.

Mayor Peitz called the meeting to order followed by all present reciting the Pledge of Allegiance. He announced that the open meeting law poster was on the back wall of the council room and reminded all present to silence their cell phones.

A motion to approve the minutes of the September 28, 2015 meeting was made by Christensen and seconded by Bartling. A roll call vote was taken. Christensen – yes, Bartling – yes, and Kruse – yes. Motion carried.

A building permit submitted by M. Kleinschmit for a solar array was reviewed. A motion to approve the permit was made by Christensen and seconded by Kruse. A roll call vote was taken. Christensen – yes, Kruse – yes, and Bartling – yes. Motion carried.

Tom Moser, Lewis and Clark NRD, visited with the council pertaining to livestock confinement permits that are issued by DEQ. A map was distributed showing the area near Hartington. Some of the animal feeding operations exist within the City of Hartington’s well head protection area. A monitoring well is located by the airport.

Deputy Travis Howell, Cedar County Sheriff Department, gave the following report. There were 445 hours patrolled with 10.25 hours for school traffic. Calls of service were 4 EMS assists, 1 accident, 3 disturbances, 1 suspicious person, 1 theft, 1 vandalism, and 4 traffic controls. Traffic stops were 2 verbal warnings, 7 written warnings, and 1 arrest.

Resolution 20151012 – zero balances was introduced by Councilman Kruse. A motion to adopt

the resolution was made by Kruse and seconded by Christensen. A roll call vote was taken. Kruse – yes, Christensen – yes, and Bartling – yes. Motion carried.

The Lucas maintenance agreement in the amount of $4,760.00 for four years was the next item on the agenda. A motion to approve the agreement was made by Christensen and seconded by Bartling. A roll call vote was taken. Christensen – yes, Bartling – yes, and Kruse – yes. Motion carried.

Dan Kathol gave an update on the water quality project. Pay request No. 7 for reservoir signage was presented. A motion to approve the pay request in the amount of $771.87 was made by Kruse and seconded by Christensen. A roll call vote was taken. Kruse – yes, Christensen – yes, and Bartling – yes. Motion carried.

Amendment No. 1 to the SRF loan had been reviewed by Legal Adviser Pier. The dollar amount of the loan changed from $780,000.00 to $820,000.00. A motion to approve the amendment was made by Kruse and seconded by Christensen. A roll call vote was taken. Kruse – yes, Christensen – yes, and Bartling – yes. Motion carried.

The following department reports were given.

PARK/POOL – Councilwoman Addison: None

COMPLEX/AUDITORIUM – Councilman Kruse: The wall mats for under the basketball hoops in the Auditorium have been ordered.

FIRE/AMBULANCE – Councilman Christensen: None

GENERAL – Mayor Peitz: None

There were no public comments.

The Board of Education met for the Board Workshop at 6:30 p.m. at 106 W Main.

Members present: Jason Dendinger, Dana Rosener, Brenda Steiner, Dale Blatchford, Bryan Gotch, Gerri Jueden, Colin Kathol, Doug Miller, and Ron Pearson. Others present: Supt. A.J. Johnson, Marcia Herring, NASB representative.

Notice of meeting was given by publication in the Cedar County News on October 21, 2015 Publication and notice indicated the meeting place, date and time.

President Dendinger called the regular October 26, 2015 Board Workshop Meeting to order at 6:30 p.m.

President Dendinger informed all present of the Open Meetings Law and pointed out the copy of the Open Meetings Law Chapter 84 Article 14 poster on the Board Room wall.

No actions were taken nor any motions made. The workshop adjourned at 9:20 p.m.
